Bio: Terry works almost exclusively with high net worth individuals and the owners of medium sized and emerging businesses. He has over 20 years experience advising such clients and their advisers on a broad range of issues. His aim is to provide clients with holistic, practical and robust solutions. Terry has worked as a tax specialist in New Zealand since 1993. Prior to founding Baucher Consulting Limited he spent six years with a "Big Four" accountancy firm including a period in Sydney advising Australian businesses on how to do business in New Zealand and three years as an associate at a specialist tax consultancy firm. Before moving to New Zealand Terry worked as a tax specialist in the UK for nine years. Terry has a law degree from Manchester University and is a member of the Taxagents Institute of New Zealand, the British Chartered Institute of Taxation and of the London based Society of Trust and Estate Practitioners (STEP).     Has the Court of Appeal decision in C of IR v Control Pacific Limited [2009] NZCA 568 given the Commissioner of Inland Revenue a blank cheque to…well…close the cheque book?

    At stake was whether the Commissioner was bound to pay Contract Pacific Ltd a GST refund totalling $6,669,061.74 because he had not complied with section 46 of the Goods and Services Tax Act 1985 which sets out the circumstances in which the Commissioner may withhold a GST refund.
